1. Reason for revision

It is intended to supplement some provisions for efficient operation of the system by strengthening safe control of household chemical products and biocidal products, by improving calculation of applicable times of violation in relation to aggravated disposition against accumulated violation, and by establishing special cases in relation to restriction of effect and efficacy advertisement of biocidal products through prior confirmation of approval postponement of biocidal materials in household chemical products to be checked for safety and through clear notification of whether or not of report or approval when advertising products.

2. Main content

A. Addition of the documents to be submitted when applying confirmation of household chemical products to be checked for safety (Revision of Article 5.1 and Appendix Sheet i of the Rule)

If a household chemical product to be checked for satisfaction of the safety standard under Article 10 of the Act includes a biocidal material, confirmation of the product shall be applied with submission of documents to prove that the biocidal material was approved or the approval was postponed under Article 12 of the Act.

B. Embodiment of prohibition sentences in marking and advertisement in order to avoid that mistaking or misunderstanding is caused in consumers in relation to hazard levels of products (Revision of Article 34.1 of the Rule)

It is intended that the Minister of Environment determines detailed content of “similar expressions” as a notification in addition to the sentences prohibited in marking and advertisement of household chemical products and biocidal products to be checked for safety in accordance with Article 34 of the Act and Article 34 of the Enforcement Rule thereof.

C. Revision is made so that the sentences to confirm report and approval numbers of products when advertising products in order to prevent possible hazard caused by use of products.

D. Provisions are improved for reasonable calculation standard on applicable times of aggravated administrative disposition against violation (Appendix Table 3) and for exemption from application of accumulated times for aggravated disposition against violation before certain period (three years).

E. Legislatively insufficient matters are improved with establishment of special case provisions for application time in order to prepare whole matters needed when advertising biocidal products reported before enforcement of the Regulation on restriction of effect and efficacy advertisement of biocidal products.
