1. Reason for proposal
The aim is to decide the details delegated by the Industrial Cluster Development and Factory Establishment Act and its Enforcement Decree for the smooth execution of the national professional qualification system (laboratory safety manager) established with the full amendment of the Act (Act No. 17350, promulgation on June 9, 2015) and to improve the compensation standard so that investigators may be adequately compensated for laboratory accidents upon their occurrence. The draft also intends to supplement some insufficiencies found during the operation of the system and to arrange some provision system in order to provide education & training systematically and manage the histories of completers with the establishment of the form of laboratory safety education & training completion certificate.
2. Main content
A. Establishment of form of laboratory safety education & training completion certificate for the systematic management of education & training completers in investigation fields (Article 10 and Form No. 6 of the draft)
B. Increase of care compensation limit from “not less than KRW 100 million” to “not less than KRW 200 million” for the minimization of burden of treatment costs to investigation personnel and for adequate compensation for accidents (Article 15(1)1 of the draft)
C. Establishment of detailed execution standard of the national professional qualification system (Articles 21 through 23 and Forms No. 14 through 16 of the draft)
1) Time and method of notification of tests
※ Notification in the website of the Ministry of Science and ICT no later than 90 days before the qualification tests
2) Submission of application forms and payment of fees
3) Issuance and reissuance of qualification certificates
D. For the case of re-delegation of the work for the tests of the national professional qualification system and for education & training, a detailed procedure is established so that regulations on such notification and management/operation may be established (Article 24 of the draft)
