1. Reason for amendment
With the Industrial Accident Compensation Insurance Act amended to improve the return-to-work rate of industrial accident workers, the Korea Workers' Compensation & Welfare Service may ask employers to prepare and submit return-to-work plans, and industrial accident insurance may be applied to student investigators (Act No. 18181, promulgation on January 1, 2022; Act No. 18040, promulgation on April 13, 2021, enforcement on January 1, 2022); the aim is to establish the procedure for submitting return-to-work plans and the standard for designation of return-to-work supporting medical institutions, etc, to establish the standard for payment of insurance benefits to student investigators, to abolish the employers’ opinion submission system in order to shorten the processing period of occupational diseases, and to reflect revised matters of other acts and subordinate statutes.
2. Main content
A. Omission of employer’s opinion submission when applying for medical care benefits (Article 20 of the draft)
○ Abolition of employer’s opinion submission to shorten the processing period of medical care benefits due to prolonged processing periods of occupational diseases owing to the increased number of cases of applications for industrial accidents caused by occupational diseases
B. Operation of return-to-work plan submission system (Establishment of Articles 61-2 through 61-4 and Article 10 of the draft)
○ Procedure for submitting return-to-work plans
- Establishment of period for submitting return-to-work plans and detailed contents to be prepared
○ Standard and procedure for and cancellation of designation of return-to-work supporting medical institutions
- Establishment of standard for manpower and facilities when applying for designation of return-to-work supporting medical institutions, establishment of method of application and reasons for cancellation of designation, etc.
C. Standard for payment of insurance benefits to student investigators (Articles 74-2 and 74-3 of the draft)
○ Statement of the standard to be followed for the payment of insurance benefits to student investigators and establishment of standard for payment of shutdown benefits caused by re-care
