1. Reasons for Amendment

The amendment allows the Minister of Employment and Labor to determine the application period and eligible types of business/applicants for the employment incentives program. It prescribes grounds on which to extend the applicability of employment insurance to include five additional occupations as of July 2022, and updates relevant provisions that cite the Farmland Act and Enforcement Decree of the Act on the Collection of Insurance Premiums for Employment Insurance and Industrial Accident Compensation Insurance in accordance with amendments made thereto.


2. Major Provisions


A. Prescribe provisions concerning the application period for employment incentives (Article 17, paragraph 2, etc.)

Clearly stipulate in the Enforcement Decree and Enforcement Rule the legal grounds concerning the application period for the employment incentives program, which was previously prescribed in Notices, etc., to address cases where such provisions were unclear or unspecified.


B. Prescribe selection criteria for types of businesses eligible for employment incentives (Article 19, paragraph 6, etc.)

Prescribe grounds on which to determine the eligible types of businesses for employment incentives programs that only specify eligibility criteria*.

* Subsidies for employee retention, subsidies for promotion of local employment, incentives for promotion of employment, and incentives for employment security during the period of childbirth and child care

※ Example: State and local governments, public institutions, and other institutions of a public nature shall be excluded.


C. Add occupations covered by employment insurance for persons in special types of employment (items under Article 104-11, paragraph 1)

Prescribe the grounds on which to extend the applicability of employment insurance to include workers in five additional occupations as of July 2022 (Employment Insurance Committee resolution, March 4, 2022).

* IT software freelancers, truck owner-operators (distribution and delivery drivers, local and regional courier drivers, transportation drivers for motor vehicles/grain powders/grains/fodder), caddies, tourism interpreters, school bus drivers


D. Update in accordance with amendments to other statues (Article 142-2, subparagraph 3, item d, etc.)

Reflect changes to provisions concerning the monthly remuneration amount for workers in accordance with the amended Enforcement Decree of the Act on the Collection of Insurance Premiums for Employment Insurance and Industrial Accident Compensation Insurance, and update provisions to reflect a change in terminology from “farmland ledger” to “farmland cadastre” in accordance with the amended Farmland Act.
