1. Reasons for Proposal
The Amendment improves standards for consultations on amendments to environmental impact assessments, and revises the wording in provisions to ensure clear understanding.
It incorporates matters that have been adjusted through five-yearly reviews of whether to assess plans subject to strategic environmental impact assessments in accordance with Article 10-2 of the “Environmental Impact Assessment Act,” and updates the titles and provisions of various statutes with respect to plans/projects subject to environmental impact assessment, etc. and the timing of consultations.
2. Major Provisions
A. Improve provisions to state that changes made to projects during consultations on amendments to environmental impact assessments shall be determined cumulatively with previous amendments to the projects, and the revised wording of provisions to ensure clear understanding (Article 55)
B. Adjust the scope of plans subject to strategic environmental impact assessments (attached Table 2)
1) Newly included: Industrial area master plans pursuant to Article 6 of the “Special Act on the Management and Promotion of Urban Industrial Areas,” marine spatial management plans pursuant to Article 7 of the “Act on Marine Spatial Planning and Management,“ industrial improvement zone plans pursuant to Article 13 of the “Special Act on the Management and Promotion of Urban Industrial Areas,” and industrial innovation zone plans pursuant to Articles 22 and 23 of the “Special Act on the Management and Promotion of Urban Industrial Areas”
2) Excluded: Special zone management plans pursuant to Article 34 of the “Special Act on Promotion of Special Research and Development Zones,” metropolitan landfill site environmental management plans pursuant to Article 5 (1) of the “Act on the Establishment and Management of Sudokwon Landfill Site Management Corporation”
3) Adjustment of scope: Change action plans under Article 12 (2) of the “Framework Act on Resources Circulation” from master development plans to governmental plans
C. Update titles and provisions of statutes (attached Tables 2, 2-2, 3, and 4)
