1. Reasons for Amendment
○ To improve the operation efficiency by improving the inadequate matters
in the operation of the system in relation to the “Guidelines for Designation
and Operation of Good Agricultural Practice-Certifying Institutions”
2. Major Provisions
A. Establish regulation to request supplementation of the application
documents of the certifying institutions where necessary and to prevent
supplementation periods from being included in the period of handling civil
petitions (Articles 3 (1) through (4))
* Related: Article 22 of the Civil Petitions Treatment Act and Article 11
of the Enforcement Decree of the Administrative Procedures Act
B. Clarify notification to certified farmers and representatives of good
agricultural practice facilities of an action plan following suspension or
cancellation of designation of certifying institutions (Article 6-2 (2))
* In the event of cancellation of designation, the action plan following
the disposition of cancellation of designation; in the event of suspension of
business, the action plan following the disposition of suspension of business
C. Supplement the expiration date application method in the case of
certifying institution succession (Article 8 (3))
* Apply the expiration date of the transferor in the event of transfer and
receipt; apply the expiration date of the surviving corporation in the event of
merger.
D. Establish expanded training hours for examiners and introduce
assessment to strengthen the expertise of the examiners for certification and
facility designation (Article 16)
* (Current) Minimum 24 hours of training completed → (Amendment)
Completion requirement: At least 90% attendance out of 28 hours of training and
evaluation result of 60 points or more
** Establish provision to retake the evaluation test before the end of the
following year if the evaluation results are below 60 points, and to suspend
the examination work if refresher training is not completed within the
deadline.
E. Specifically supplement the qualification requirements of the
deliberation officer (Article 17)
* (Current) A person who has conducted more than 30 certification reviews
and deliberations in the last 3 years → (Amendment) A person who has conducted
an average of 10 certification reviews or deliberations per year
** (Current) Professors with 3 years or more of GAP system research and
teaching experience → (Amendment) Professors with 3 years or more of research
related to GAP system, production, distribution, shipment, etc., and teaching
experience
F. Supplement details necessary for the designation of good agricultural
practice certification (Attached table 1)
1) Supplement for the certifying institution to designate a management
business operator for each examiner and manage at all times.
2) Limit persons who perform certification works other than good practice
certification to part-time examiners.
3) Supplement to add labor contract and wage ledger to the documents
certifying the examiner’s qualification, and to be provided from time to time
upon request from the National Agricultural Products Quality Management.
4) An official inspection report issued by a specialized inspection agency
in accordance with relevant laws shall be recognized as the inspection report.
