1. Reasons for Amendment
○ This amendment aims to reflect opinions for improvement in the industrial field for activating pseudonymized information and supplement and improve shortcomings in the operation of the system, such as the rationalization of requirements for designation of the Expert Data Combination Agency.
2. Major Provisions
A. Provide a basis for the establishment of the pseudonymized information utilization support center (Article 4)
○ Prepare a basis for the Protection Commission and each local government to foster a local data economy by installing a pseudonymized information utilization support center.
B. Rationalize the system, such as the procedure for combining pseudonymized information (Articles 4, 8, and 9-3)
○ Expand the scope of support of the Protection Commission to support the generation of combination keys through the system (online) or support center (offline) upon a request from an applicant for combinations.
○ In addition to the written submission (setting a seal) of the combination application, enhance the convenience of the combination application process by allowing it to be submitted electronically.
○ Simplify the mock combination procedure so that the combination applicant can generate a mock combination key in consultation with the Expert Data Combination Agency when doing mock combinations.
C. Reorganize provisions on the management and supervision of the Expert Data Combination Agency (Articles 5 and 12-2)
○ In cases of failing to meet the designation criteria, clearly stipulate that the Expert Data Combination Agency cannot carry out new combination affairs until the designation criteria are met.
○ In order to efficiently manage and supervise the Expert Data Combination Agency, including the Protection Commission, clearly define the submission deadline (January 31 of the following year) and applicable period (January 1 – December 31 of each year) for the annual submission of documents submitted by the Expert Data Combination Agency.
D. Alleviate criteria for the designation of the Expert Data Combination Agency (Article 9, Attached Table 1)
○ Alleviate the criteria for the designation of the Expert Data Combination Agency for the pseudonymized information utilization support center and clarify the requirements for performing combinations.
- Alleviation of the criteria for designation: Allow forming an organization with three or more people in charge and allow up to three employees from different departments to concurrently serve.
- Clarification of performance requirements: Limit the combinations recognized by the Protection Commission, such as (i) combinations for public interest and (ii) combinations that are difficult to perform in other Expert Data Combination Agencies.
○ Provide rules to exclude the application of financial requirements (5 billion Korean won of capital) for designating a non-profit corporation as an Expert Data Combination Agency.
E. Expand to private and public institutions to be allowed self-combinations to provide them to third parties (Articles 9-4, 12, and 12-2)
○ Expand self-combinations for the purpose of providing them to third parties to private Expert Data Combination Agencies to create a sound data ecosystem.
