1. Reasons for Amendment
In accordance with the amendment no. 18256 to the Pesticide Control Act (amended on 15 June 2021, to enter into force on 1 January 2023) and no. 18526 (amended on 30 November 2021, to enter into force on 1 December 2022), this Partial Amendment aims to prescribe matters delegated to it under the Act, and supplement shortcomings in the operation of the current system.
2. Major Provisions
A. Introduce system for reporting of aerial pest control business
1) Prescribe details regarding criteria for reporting personnel, facilities, equipment, etc. of aerial pest control business as delegated to it under the Act, and provide forms for reporting aerial pest control business (including any changes to such business), forms for certificate of reporting, etc.
2) Reflect aerial pest control business related matters in relevant forms for aerial pest control business registry, reporting of business succession, reporting of closedown, application for re-issuance, etc.
3) Prescribe criteria for administrative dispositions regarding aerial pest control business, etc.
B. Provide dispute mediation application procedures and mediation procedures for the Pesticide Damage Dispute Mediation Committee
1) Prescribe details regarding dispute mediation application procedures, mediation procedures, etc. of the Pesticide Damage Dispute Mediation Committee
2) Provide forms for dispute mediation application, notice of mediation, investigator identification, investigation report, settlement proposal, notice of settlement, and mediation record
C. Enhance safety control of pesticides, etc.
1) Prescribe detailed list of personal protective gear and equipment, etc. necessary for emergency measures to be mandatorily equipped by manufacturers, etc. and pest control businesses
2) Prescribe stricter registration criteria for persons desiring to engage in active ingredient business or importing who also handle pesticide active ingredients with prohibited substances or hazardous chemical substances in accordance with the Chemical Substances Control Act
D. Provide procedures for registration of export exclusive pesticides and provide procedures and criteria to enable the National Agricultural Products Quality Management Service to control pesticides in distribution
E. Deregulate procedures for registration of changes to pesticide items and clarify, etc. regulations regarding aggravated administrative dispositions
