1. Reasons for Proposal
The current regulations limit the scope of targets subject to regular inspections to large-scale outdoor storage tank, which gives rise to the problem that it is inadequate in securing the safety of facilities for hazardous substances with a similar degree of risk. Hence, to improve this, factories, etc., where hazardous substances transport pipes or hazardous substances handling tanks, etc. are buried underground are to be included in the scope of targets subject to regular inspections as well. At the same time, it aims to improve and compensate for some of the deficiencies in the operation of the current system, such as promoting the effectiveness of the technical review and completion inspection conducted in a series of procedures by having the same agency carry them out, stipulating the scope of factories and general handling places to be inspected for completion identically as that of the technical review to improve the safety of the hazardous substance facilities, and reorganizing the criteria for judging the designated quantity of Class 5 hazardous substances and the contents of classification to reasonably improve the characteristics determination work of hazardous substances.
2. Major Provisions
A. Expand the scope of targets subject to regular inspections of facilities for hazardous substances (Article 17)
The scope of targets subject to regular inspections has been limited to outdoor storage tank of not less than 500,000 liters, but in consideration of the risk of underground facilities, the difficulty of regular inspections, etc., factories, general handling places, handling places for transfer, etc. with hazardous substance pipes buried underground were added.
B. Expand the completion inspection by specialized agency of factories and general handling places (Article 22 (2) 2)
Previously, factories and general handling places were required to undergo Korea Fire Institute’s completion inspection if their hazardous substances handling amount permitted exceeded 3,000 times the designated quantity. However, in the future, the completion inspection of the relevant agency shall be required, even if the amount exceeds 1,000 times the designated quantity.
C. Classify designated quantities for Class 5 hazardous substances and improve the judgment criteria (Table 1)
The designated quantity of Class 5 hazardous substances was classified into 10 kilograms, 100 kilograms, and 200 kilograms, and the designated quantity was decided based on the product name of the hazardous substances. However, considering that the legal basis for the designated quantity of 200 kilograms is not clear, etc., 200 kilograms was deleted from the designated quantity classification of the Class 5 hazardous substances, and the criteria for judging the designated quantity were reasonably improved.
