Reasons for Amendment 

In hiring new faculty members of a university, the candidates shall undergo an objective and fair screening process by a group of examiners appointed or commissioned by the university. However, because there are no specific standards for appointing or commissioning the examiners, such matters are implemented autonomously by each university. 

In this regard, the Amendment intends to enhance the fairness of the recruitment of faculty members of universities by specifying the minimum number of examiners and the reasons for exclusion when appointing or commissioning examiners. 

Additionally, to reinforce the process of verifying the educational and career backgrounds of candidates when hiring new faculty members of universities, the Amendment also intends to explicitly prescribe these matters in the recruitment and screening processes. 



Major Provisions


A. Insert additional screening categories for the recruitment of new faculty members of universities (Article 4-3 (3)).

- Add the category of “whether the educational and career backgrounds of the candidates match the statements on their submitted documents” to the categories for basic screening for the recruitment of new faculty members of universities. 


B. Newly insert provisions on the minimum number of examiners for each screening stage (Article 4-4)

- Prescribe that there shall be at least three examiners for each screening stage, provided, however, that for the deliberation on the correspondence of each candidate’s field of study and their academic excellence, there shall be at least five examiners, one-third of whom shall be outside experts. 


C. Newly insert provisions on the standards for exclusion, etc. for the formation of the group of examiners (Article 4-5)

- Prepare the standards for exclusion when forming the group of examiners, such as persons with kinship relations, academic advisers or joint researchers, or persons with work relations, etc. In cases where there are circumstances that may affect a fair deliberation process, the candidate shall be allowed to file an application for recusal, and the relevant examiner shall be recused in cases where there exists any reason for exclusion, and the examiner shall be allowed to recuse himself/herself from the deliberation in cases where there exists any reason for avoidance. 


D. Make improvements to the wordings including provisions that quote other laws (Article 4-3)
