1. Reasons for Amendment

As the Railway Safety Act was amended (Act No. 18786, promulgated on Jan. 18, 2022, enforced on Jan. 19, 2023) to newly insert regulations to evaluate the precise safety diagnosis results conducted by the rolling stock precise safety diagnosis agency and to establish punishment regulations for poor diagnosis, the amendment prescribes matters delegated by the Act, such as the method, procedure, etc. for evaluating the results of the precise safety diagnosis, and matters necessary for the implementation thereof.



2. Major Provisions

A. Evaluation, etc. of the results of precise safety diagnosis (Articles 11 through 20 newly inserted)

Prescribe the target and methods of evaluation, evaluation criteria, and measures for the results of the precise safety diagnostics according to Article 38-14 of the Act and Article 75-19 of the Enforcement Rules, and prepare the basis for the evaluation agency to request the submission of evaluation-related data and to prescribe the details necessary for the operation of the evaluation business through detailed operating rules.


B. Detailed testing method for precise safety diagnosis (Paragraph 3 (b) of Attached Table 1 related to Article 4 amended)

Prescribe the precise safety diagnostics’ performance tests by train class and by evaluation item as follows: Power tests are maneuver, additional notch, re-power, acceleration tests; Braking tests are regular braking, emergency braking, deceleration tests; Vibration test is vibration acceleration test; Ride comfort test is ride comfort level or ride comfort index test. And newly establish the criteria for judging the performance tests so that if the criteria presented by the applicant are not met, the relevant rolling stock is determined to be unfit for use.


C. Detailed qualification requirements for precise safety diagnosis agency (Attached Table 2 related to Article 9 amended)

Newly insert “A person with a rolling stock maintenance technician license and at least seven years of experience working in the rolling stock field” to the technical qualification criteria of the diagnostician among the personnel requirements of the precise safety diagnosis agency, so that a person who meets the relevant qualifications may work as a diagnostician.
