1. Reasons for Amendment

The Marine Environment Management Act (promulgated on October 18, 2022) was amended to reflect amendments to the International Convention for the Prevention of Pollution from Ships (MARPOL), including the introduction of new energy efficiency regulations for ships in operation and allowing the electronic recording of certain compulsory records. Accordingly, this amendment specifies matters delegated by the Act, such as Energy Efficiency Existing Ship Index (EEXI) calculation and management of electronic registers, and incorporates other amendments to the Convention including the exemption of unmanned non-self-propelled (UNSP) barges from certain certifications.



2. Major Provisions


A. Increase the scope of harmful anti-fouling paint (Article 5 (4))

Add cybutryne and paint containing cybutryne to the list of harmful anti-fouling paints and incorporate into current regulations in accordance with the amended International Convention on the Control of Harmful Anti-fouling Systems on Ships (ASF Convention).


B. Prescribe description requirements and approval procedures for electronic registers (Article 24-2)

Prescribe description requirements and approval procedures, etc., for electronic registers in accordance with the introduction of electronic records for ship pollutant record books, etc.


C. Newly insert provisions on submitting Energy Efficiency Design Index (EEDI) information to the International Maritime Organization (IMO)

Newly insert procedures for submitting the EEDI calculated for each ship and the acceptable values to the IMO in accordance with the amended MARPOL.


D. Newly insert provisions on ships subject to EEXI requirements and acceptable values (Article 30-6)

Specify ships subject to EEXI requirements among ships with a total tonnage of at least 400 tons for each ship type and deadweight tonnage, and prescribe acceptable EEXI values, etc.


E. Newly insert provisions on ships subject to Carbon Intensity Index (CII) requirements and acceptable values (Article 30-7)

Specify ships subject to CII requirements among ships with a total tonnage of 5,000 tons for each ship type and deadweight tonnage, and prescribe acceptable CII values, etc.


F. Modify provisions on nitrogen oxide emission regulations (Article 32 (3))

Prescribe matters that must be specified in the engine logbook when entering or exiting a sea area subject to regulations on nitrogen oxide emissions, such as the operating status of the engine.


G. Newly insert provisions on fuel oil sampling locations, etc. (Article 34 (5) and (6))

Prescribe provisions on fuel oil sampling requirements and locations where fuel oil samples may be collected to check for sulfur content, etc.


H. Prescribe grounds on which UNSP barges may be exempted from Convention requirements (Article 48 (3) and (4))

Prescribe that UNSP barges that do not have a propulsion system and that do not have any persons, etc., on board as specified in MARPOL may be exempt from inspections of marine pollution prevention equipment, etc.
