1. Reasons for Amendment
This amendment is intended to establish detailed procedures and standards for livestock raising facilities restriction and closure orders under Article 19 of the Act on The Prevention of Contagious Animal Diseases so that raising restriction and closure orders can actually work on the site, and to establish a basis for state funding for farmers who have suffered losses due to the raising restriction orders.
2. Major Provisions
A. Establish procedure and standard for orders to restrict raising and close livestock-raising facilities (Article 6 Amended and Attached table 1-2 newly inserted)
1) As the current procedure and standard for livestock raising facilities’ raising restriction and closure orders are unclear, it is necessary to stipulate them clearly
2) Clearly establishing the procedures of hearings and standards for administrative disposition is expected to raise the predictability of those subject to administrative disposition
B. Improve the standards for payment of compensation for slaughtering (Article 11 and Attached table 2 amended)
1) It is necessary to establish a basis for state-funded subsidy for compensation under the current raising restriction order that local governments shoulder the full amount (Article 11 (5))
2) Preparing the basis for the State to support the compensation pursuant to the raising restriction order (Attached table 2) is expected to improve the compensation system reasonably to increase policy cooperation
