1. Reasons
for Proposal
The “Promotion of the Motion Pictures and Video Products
Act” was partially amended (Act No. 18985; promulgated on September 27, 2022;
to be enforced on March 28, 2023) to introduce a self-classification system for
online media services (over-the-top), and to designate and re-designate
self-classifying enterprisers. Accordingly, the Amendment prescribes matters
necessary for designation applications, revocation of designation, and other
enforcement.
2. Major
Provisions
A. Specify
the method for electronically verifying lawful rights to videos provided via
information and communications networks (symbol/mark or enterpriser website, etc.
displayed on videos) (Article 23-3)
B. Specify
self-classification operation plans, youth/user protection plans, and other
document requirements and application procedures for self-classifying
enterpriser designation (Article 23-4)
- Procedures to confirm enterpriser compliance with
obligations each year during the designation period, business suspension, and
fulfillment of plans submitted upon designation during the designation period
for re-designation
C.
Prescribe procedures to revoke the designation of a self-classifying
enterpriser, standards concerning business suspension, public announcement in
an official gazette after administrative penalties, etc. (Article 23-5)
D. Ensure
the stable and efficient operation of the self-classification system by
authorizing the Korea Media Rating Board to designate and re-designate
enterprisers and perform other specific administrative tasks (Article 33-4)
