1. Reasons for Enactment
As the International Civil Aviation Organization mandated health promotion activities for flight crews such as air traffic controllers and pilots who are required to obtain the aviation medical examination certificate, the Aviation Safety Act was revised (Act No. 18789; promulgated on January 18, 2023, and implemented on January 19, 2023) to obligate the Minister of Land, Infrastructure and Transport, those who obtain air traffic services certification, air operators, aircraft use business entities, or the owners, etc. of an aircraft for international flight operation to annually formulate and implement health promotion activity plans for flight crews under their supervision. So, this amendment aims to define the details necessary for the formulation and implementation of the health promotion activity plans delegated by Ordinance of the Ministry of Land, Infrastructure and Transport (Article 96-2; to be implemented on January 19, 2023).
2. Major Provisions
A. Specify in detail what business entities, etc., should include when establishing the health promotion activity plans (Article 4).
B. Have business entities, etc., designate dedicated departments or personnel for health promotion activities, and in cases of difficulty in the designation such as lack of personnel, allow outsourcing to be possible (Article 5).
C. Stipulate that pilots and controllers must actively participate in health promotion activities provided by business entities, etc., and may present opinions on health promotion activities (Article 6).
D. Business entities, etc., shall review the implementation performance of the health promotion activity plans and evaluate health promotion activities at least once a year and reflect them in the next plan (Article 7).
