1. Reasons for Amendment
Evacuation spaces or alternative facilities installed instead of escape routes (direct staircases) for apartment fire should be installed in appropriate locations and sizes, but since they are used only in emergencies, they tend to be installed in inappropriate sizes and as low-price facilities that may infringe on the privacy of neighboring households. To improve the evacuation, safety from crime, living conditions, etc. of apartment residents, it is necessary to induce active evacuation spaces or the installation of alternative facilities by excluding floor areas.
2. Major Provisions
A. Evacuation space area calculation standards, etc. (Article 46)
If the minimum space is secured based on a wall centerline, there is a possibility that the internal area of the actual evacuation space may not be sufficiently secured, so it is necessary to amend the Enforcement Decree to secure the minimum area based on interior measurements, which are the distances between walls, and consider design diversity depending on conditions by allowing evacuation spaces to be installed not only inside balconies but also adjacent to them.
B. Exclude the floor area of an apartment evacuation space, etc. (Article 119)
Although it is a space used only in emergencies, exclude it from the floor area calculation to fully perform its functions and induce safer facility installation However, it is necessary to set an upper limit for the excluded area to prevent abuse, such as diverting evacuation spaces for other purposes.
