1. Reasons for Amendment 

This amendment aims to redefine the scope of major roads in major cities and improve noise criteria in residential areas, etc., in order to properly balance the right of assembly and public safety/order by guaranteeing the right of lawful assembly/demonstration while protecting the general public’s right to smooth traffic flow and peaceful privacy.

2. Major Provisions

A. Redefine the scope of major roads in major cities (Attached Table 1)

The provisions governing major roads were introduced from the time the Act was enacted in 1962, which have been periodically revised to reflect trends in road traffic, and since the last revision in 2014, there have been many changes in traffic, road conditions, status of assemblies/demonstrations, location of major facilities, etc. Therefore, this amendment aims to redefine the scope of major roads by updating 27 provisions with changes in the status quo due to address changes and relocations of major institutions while stipulating 87 major roads by deleting 12 of the current 88 roads and adding 11 roads.

B. Improve noise criteria (Attached Table 2)

In order to ensure peaceful privacy against excessive noise from assemblies that disturb the public, this amendment aims to improve the noise measurement method by ① reducing the equivalent noise level measurement time from 10 minutes to five minutes in residential areas, etc., and ② strengthening the criteria for determining a violation of the highest noise level from the previous three times to two within an hour.

C. Introduce a sunset provision on major roads in major cities (Article 19 Subparagraph 4)

This aims to review the scope and existence of major roads in major cities in consideration of traffic, road conditions, the status of assemblies/demonstrations, the location of major facilities, etc.
