1. Reasons for Amendment
The Amendment clarifies the timing at which a person who has qualified as a dependent by fraudulent or unlawful means becomes disqualified, allows a person who meets income and asset requirements to qualify as a dependent without providing evidence of business closure, and otherwise addresses and improves upon a number of weaknesses that have emerged from the operation of the current system.
2. Major Provisions
A. Clarify the timing at which a person who has qualified as a dependent by fraudulent or other unlawful means becomes disqualified (Article 2 (3) 9)
Clarify that where a person has qualified as a dependent by fraudulent or unlawful means, the person shall be disqualified as of the day on which he/she qualified as a dependent.
B. Clarify the timing at which a person is disqualified as a dependent based on business income, etc. after monthly income or contribution point adjustment (Article 2 (3) 10)
Clarify that where a person no longer meets income requirements for dependents due to business income, etc. generated after monthly income or contribution point adjustment:
1) If the business income, etc. was declared in accordance with Article 41-2 (3) or Article 42 (2) of the Decree, the person shall be disqualified as a dependent on the last day of the month after the month containing the day on which the business income, etc. was generated, which is the end date of the declaration period;
2) If the business income, etc. was not declared in accordance with Article 41-2 (3) or Article 42 (2) of the Decree, the person shall be disqualified as a dependent on the last day of the month containing the day on which the business income, etc. was generated.
C. Exclude the submission of “documents to verify business closure” when declaring qualification as a dependent (Article 2 (4) 3, attached Form 1)
Allow any person who meets income and asset requirements for dependents under attached Table 1-2 to qualify as a dependent regardless of whether he/she has provided evidence of business closure by deleting provisions on the submission of relevant documentary evidence.
