Reasons for Enactment
The Act on Stalking Prevention and Victim Protection, etc. (Act No. 19216) was enacted on January 17, 2023 to prevent stalking and protect and support victims, etc., and thereby contribute to the promotion of human rights. Accordingly, the Decree prescribes matters delegated by the Act and matters necessary for the enforcement thereof, thereby aiming to keep the public safe from stalking and enable victims to make a speedy recovery and healthy return to their everyday life.
Major Provisions
A. Prescribe in detail matters concerning the content, method, etc. of a stalking investigation (Article 2)
B. Prescribe the administration of prevention education, scope of public organizations required to establish in-house prevention guidelines, etc. (Article 3 and Article 4)
C. Prescribe matters to be included in recurrence prevention measures in the event of a stalking incident, and the formulation and enforcement of measures against sexual violence and sexual harassment in the event of a complex incident (Article 5)
D. Prescribe procedures for supporting school-age children, grounds for recognition of attendance (Article 6)
E. Prescribe the scope of institutions or organizations entrusted to install or operate support facilities, facility equipment and operation, number of employees, and other detailed standards (Article 7 and Article 8)
F. Prescribe employee eligibility criteria and training requirements for support facilities (Article 9, Article 10, and Article 11)
G. Prescribe grounds for handling sensitive information, etc. and criteria for imposing administrative fines (Article 12 and Article 13)
