1. Reasons for Amendment
This amendment aims to provide methods and procedures for checking containers established in line with the revision of the Ship Safety Act (Act No. 19134; promulgated on December 27, 2022 and to be enforced on June 28, 2023) and to strengthen container safety management and improve the container safety checkup methods in conformity with the standards of the International Convention for Safe Containers.
2. Major Provisions
A. Newly insert methods and procedures for checking containers (Article 10, Attached Forms. 1 and 2, and Attached Tables 3 and 4 newly inserted)
Have a public official from the Regional Office of Oceans and Fisheries check containers entering Korean ports, and establish standards and handling procedures for defects that require the suspension or transportation restriction of such containers.
B. Improve container safety inspection methods (Article 4 revised)
Change the qualification requirements for inspectors by reflecting the registration requirements for safety checkup business operators newly established in Article 63 of the Enforcement Rule of the Ship Safety Act, and specify matters to be included in container owners’ safety inspection method in accordance with the standards of the International Convention for Safe Containers.
C. Divide current standards into three chapters to reflect revisions, and modify some of the terminologies in accordance with the easy-to-understand standards for legislative drafting.
