1. Reasons for Amendment
As the Functional Sericulture Industry Fosterage and Support Act was revised and promulgated (Dec. 27, 2022) to expand the scope of the functional sericulture industry, this amendment aims to add a range of functional sericulture products, establish matters delegated by the Act such as cultivating excellent silkworm breeds and producing/supplying excellent silkworm eggs and matters necessary for their implementation, and newly insert provisions for the delegation of authority.
2. Major Provisions
A. Amend provisions to add the range of functional sericulture products (Article 2)
○ Amend provisions to add silkworm droppings, as well as the branches and roots of mulberry trees, to the range of “products prescribed by Presidential Decree” under the Act.
B. Insert new detailed regulations for the functional sericulture industry master plan/action plan (Article 3)
○ Insert new provisions that stipulate matters necessary for the establishment/implementation of the master plan and the action plan which should be prescribed by Presidential Decree delegated by the revised Act.
C. Establish detailed provisions for cultivating excellent silkworm breeds and producing/supplying excellent silkworm eggs (Article 5)
○ Establish new provisions that regulate matters on policies for cultivating excellent silkworm races and producing/supplying excellent silkworm eggs which should be prescribed by Presidential Decree delegated by the revised Act.
D. Establish detailed provisions for the designation of professional training institutions for the sericulture industry (Article 6)
○ Establish new provisions that stipulate matters necessary for the designation of professional training institutions which should be prescribed by Presidential Decree delegated by the revised Act.
E. Establish and add new provisions for the delegation of authority (Article 7)
○ Insert new provisions for the delegation of authority for cultivating excellent silkworm breeds, producing/supplying excellent silkworm eggs, and training experts, which were established by the revision of the Act.
