1. Reasons for Amendment
This Amendment prescribes specific qualification requirements in accordance with the new insertion of the preparation of flood maps within the scope of services provided by agents for disaster prevention and management, clarifies standards for determining the degree of aggravation of administrative fines, and reflects other matters delegated by the amended Countermeasures Against Natural Disasters Act (Act No. 19331; promulgated on April 11, 2023) while also addressing and improving upon a number of weaknesses that have emerged from operation.
2. Major Provisions
A. Newly insert “preparation of flood maps” into the scope of services that may be registered by agents for disaster prevention and management (Article 32-2)
1) Follow up on the amended Article 38 (2) of the Act by adding the preparation of flood maps to the registration requirements for persons who intend to carry out disaster prevention and management duties as a proxy, thereby prescribing legal grounds for the delegation of work, etc.
B. Newly insert qualification requirements required for preparing flood maps (Article 32-2, attached Table 3)
1) Prescribe detailed regulations on technicians and areas of specialization required for preparing flood maps.
C. Clarify standards for aggravating administrative fines (attached Table 4)
1) Clarify standards for aggravating administrative fines so as to ensure that dispositions imposed at least 1 year previously are not included when determining the degree of aggravation.
