1. Reason for Amendment

The National Health Insurance Act was amended (promulgated on May 19, 2023; enforced on November 20, 2023) to allow the collection or payment of any financial gain or loss to a pharmaceutical company resulting from a decision to suspend execution upon an administrative lawsuit regarding drug price-related dispositions. Accordingly, this Amendment prescribes the calculation standard, period, and other details of the amount equivalent to the loss to be collected or paid by the National Health Insurance Service. It also modifies standards on the imposition of employer contributions in some business categories, allows overdue notices for insurance contributions to be received by email, establishes a health care cost tax information sharing system between the National Health Insurance Service and the National Tax Service so that it is not necessary to submit and retain documents if information on electronic tax invoices and cash receipts has been submitted when claiming health care costs, and otherwise addresses and improves upon a number of weaknesses that have emerged from the operation of the current system.



2. Major Provisions


 A. Change the term “certificate of a person of distinguished service to the State” to “National Veteran Registration Card” in accordance with the integration of veteran identification cards and changes in names (Article 7).


 B. Modify provisions in accordance with changes to laws applicable to public officials exclusively in charge of social welfare (Article 14 (2)).


 C. Prescribe matters concerning the omission of submitted and retained documents when information on electronic tax invoices and cash receipts has been submitted upon claiming health care cost payments (Article 23 (3) and (5), Article 58 (4), attached Forms 18 through 19-5).


 D. Change the term “motorized scooter” to “medical scooter” in the scope of assistive devices for people with disabilities that are eligible for insurance coverage, and increase the coverage of “motorized wheelchairs, motorized scooters, and batteries” (Article 26, attached Table 7, attached Forms 21, 22-2, and 24).


 E. Prescribe the details for receiving overdue notices for insurance contributions by email (Article 49, attached Form 39). 


 F. Prescribe the details for calculating the amount equivalent to the loss to be collected or paid by the National Health Insurance Service when a decision is made to suspend execution in a lawsuit regarding drug price-related dispositions (Article 60-2 and attached Table 8-2 newly inserted).


 G. Modify relevant forms providing information on allowance suspension for persons staying abroad (attached Forms 18 through 19-5). 


 H. Delete the portion in the health insurance application form used to apply for the Job Stability Fund assistance program (January 2018 - June 2022), which is no longer available (attached Table 27).
