1. Reasons for Proposal
In light of the Pangyo data center fire and service outage (October 15, 2022), the Framework Act on Broadcasting Communications Development was amended (Act No. 19152; promulgated on January 3, 3023; enforced on July 4, 2023) to include major data center operators, etc. of a certain size or larger in the scope of business entities that are required to establish and operate a communications disaster management system. Accordingly, this Amendment prescribes grading and classification standards and management measures for key communications facilities of data centers, other matters delegated by the Act and Enforcement Decree, and matters necessary for the enforcement thereof.
2. Major Provisions
A. Expand the scope of application of grading and management standards (subparagraphs 1 and 2 of Article 2 newly inserted)
Expand the scope of application of grading and management standards for key communications facilities to include data centers that are installed and operated by major data center operators, and thereby impose an obligation to take management measures such as ensuring a stable supply of power, restricting access, and ensuring security.
B. Newly insert grading and classification standards for key communications facilities of data centers (Article 4 (1) and attached Table 1 amended)
Designate as a Grade A key communications facility any data center provided by a major data center operator, etc. with a server room floor area of 22,500 square meters or a passive equipment capacity of 40 megawatts or more.
