1. Reasons for Amendment
The Framework Act on Resources Circulation was wholly amended to the Circular Economy Transition Promotion Act (Act No. 19208; promulgated on December 31, 2022; to be enforced on January 1, 2024) to ensure the efficient use of resources, reduce waste generation, and promote circular utilization at all stages of production, consumption, distribution, etc. and thereby support the transition to a sustainable circular economy. Accordingly, this Amendment specifies activities that correspond to circular utilization, stipulates requirements and methods for recycled content claims, and prescribes other matters delegated by the Act and matters necessary for the enforcement thereof.
2. Major Provisions
A. Change the title of the Rule from “Enforcement Rule of the Framework Act on Resources Circulation” to “Enforcement Rule of the Circular Economy Transition Promotion Act” in accordance with the change in the name of the Act to the “Circular Economy Transition Promotion Act” (Title).
B. Prescribe that activities corresponding to circular utilization shall include reusing an article in its original form after repair or mending, restoring the original performance of an article after a process of dismantling, washing, inspection, repair, adjustment, reassembly, etc., and sorting and segregating articles (Article 2).
C. Prescribe items to be submitted by Si/Do areas to establish and manage circular economy targets, and stipulate business categories, sizes, target setting, and compliance methods for business entities (Article 9 and Article 10).
D. Prescribe selection criteria for products subject to circular utilization assessment to consider such factors as the quantity of products, etc. delivered/imported or produced/distributed and the current status and ease of circular utilization (Article 11).
E. Prescribe that a recycled content claim may only be made for a product containing at least 10 percent quality-certified circular resources based on the weight of the materials used per product, and prescribe the procedure and method for issuing recycled content certificates (Article 19).
