Major Provisions
A. Prescribe an obligation to prepare and manage a marine facility pollution emergency plan, etc. (Article 19)
- Add pollutant storage facilities to the scope of facilities that are required to prepare and manage a marine facility pollution emergency plan.
B. Requirements for reporting changes in pollutant storage facilities and deadline for notification of acceptance or rejection of reports/change reports (Article 21-2, Article 21-3)
- Prescribe requirements for reporting changes in pollutant storage facilities and prescribe a deadline for notification of acceptance or rejection of reports/change reports.
C. Various forms (Article 21-4, attached Forms 19-3 through 19-6)
- Prescribe various forms delegated by Presidential Ordinance to the Ministry Ordinance (pollutant storage facility installation report, certificate of report of installation, application for reissue of certificate of report, report of business closure).
D. Pollutants management ledger submission procedure, etc. (Article 22)
- Prescribe detailed procedures for the submission of pollutants management ledgers of private pollutant storage facilities.
E. Standards on the installation/operation of private pollutant storage facilities (Article 23 (2), attached Table 10-2)
- Prescribe in attached Table 10-2 standards on the installation/operation of pollutant storage facilities that are installed/operated by a person who is not a sea area management authority.
F. Detailed criteria for administrative dispositions in the event of non-compliance, etc. (Article 23-2)
- Prescribe in attached Table 10-3 detailed criteria for administrative dispositions (improvement of facilities, suspension of operation for up to 6 months, closure of facilities) that may be used by sea area management authorities in the event of any one of the subparagraphs of Article 28-3 (1).
G. Modify delegated provisions in accordance with the abolition of the type approval of marine environment measuring apparatus (Articles 61 through 65)
- Modify delegated provisions in accordance with the abolition (April 25, 2024) of the type approval of marine environment measuring apparatus under Article 110 (1) and (2).
