1. Reasons for Amendment
In keeping with the rising number of multicultural students, there has been growing emphasis on the importance of formulating systematic multicultural education policies and establishing an environment where multicultural students can learn without discrimination.
Accordingly, Article 28-2 of the Elementary and Secondary Education Act was newly inserted (October 24, 2023) to prescribe grounds to conduct fact-finding surveys on multicultural education and grounds concerning the establishment, operation, designation, delegation, etc. of multicultural education support centers. However, the Article delegates detailed matters to a Presidential Decree, and this Amendment specifies the relevant details in the Decree.
2. Major Provisions
A. Scope and method of fact-finding surveys on multicultural education (Article 54-4 newly inserted)
1) Reflect the intention of the amended Elementary and Secondary Education Act (October 24, 2023), which prescribes fact-finding surveys on multicultural education to formulate and enforce multicultural education policies necessary for education
2) Prescribe matters concerning the scope, method, cooperation procedure, etc. of fact-finding surveys on multicultural education
B. Establishment and operation of multicultural education support centers, etc. (Article 54-5 newly inserted)
1) The Elementary and Secondary Education Act prescribes that multicultural education support centers may be established and operated, designated, or delegated to support the education of multicultural students, etc.
2) Allow the establishment and operation, designation, or delegation of multicultural education support centers by central and local authorities, and prescribe the roles and responsibilities thereof.
