1. Reasons for Amendment
The Ballast Water Management Act was amended (Act No. 19771; promulgated on October 24, 2023; to be enforced on April 25, 2024) to improve the type approval system and accordingly, this Amendment modifies systems concerning the type approval of ballast water treatment systems and prescribes matters such as a performance survey procedure for quality control of type approvals.
2. Major Provisions
A. Prescribe a performance survey procedure for ballast water treatment systems (Article 34-2 newly inserted)
Allow performance surveys to be conducted on any ballast water treatment system, etc. whose type approval is revoked or validity is suspended. Prescribe reasons for which a ballast water treatment system may be supplemented, exchanged, recalled, destroyed, or suspended from sale, and actions to be taken according to performance survey results.
B. Modify disposition standards for revocation of type approval, etc. (attached Table 12 amended)
Modify disposition standards for revocation of type approval, etc. in such cases as those where a person who has obtained type approval fails to obtain approval for a change.
C. Prescribe procedures for revoking a pass result in a type approval test (Article 34 (3) newly inserted)
Prescribe that when a pass result in a type approval test is revoked, the testing institution for type approval shall be immediately notified of the fact thereof.
D. Amend the format of ballast water entry reports, ballast water management record books, and ballast water treatment system type approval certificates
Amend relevant forms to reflect amendments to the International Convention for the Control and Management of Ships' Ballast Water and Sediments and supplement the ballast water treatment system type approval certificate.
