1. Reason for enactment

With the enactment of the “Act on the Promotion of Management and Utilization of Industrial Property Information” (abbreviated as “Industrial Property Information Act,” Law No. 20200 to be promulgated and implemented on Aug. 7, 2024) to promote the utilization of patent data, its Enforcement Rules are aimed at stipulating the items necessary for the implementation of the Act and its Enforcement Decree as delegated by them.

2. Main contents

  a. Purposes (Article 1 of the Draft)

The legislative purposes of the proposed Rules are defined to prescribe matters delegated by the Industrial Property Information Act and its Enforcement Decree and matters necessary for their implementation. 

  b. Documents to be digitalized and notification, etc. of digitalized contents (Articles 2 and 3 of the Draft)

To transfer matters related to the digitalization and notification of contents of industrial property documents under the Enforcement Rules of the Patent, Utility Model, Design, and Trademark Acts

  c. Designation of agencies to digitalize industrial property documents and provision of operating regulations, etc. (Articles 4 and 5 of the Draft)

To transfer matters related to the designation of agencies to digitalize industrial property documents under the Enforcement Rules of the Patent, Utility Model, Design, and Trademark Acts and matters related to the operating regulations of said agencies

  d. Designation of institutions for examination of industrial property (Article 6 of the Draft)

To prescribe the document forms of application for and certificates of designation of institutions for examination of industrial property delegated by Article 9 of the Enforcement Decree of the Act
