2. Reason for proposal
In order to manage the bunker fuel supplying business systematically and improve the external reliability of the domestic bunker fuel supplying business, bunker fuel suppliers shall install bunker fuel supply-measuring devices to check whether the amount of bunker fuel supplied to foreign navigation vessels is within the tolerance range, shall keep such measurement results, and shall assume liability for proper volume supply.
In order to improve and supplement some operational insufficiencies in the current system, as the harbor transport-related business is registered or reported for each port, the business area is limited to the registered or reported port, but a harbor transport-related business engaged in a ship fuel supply business using a fuel supply vehicle is not subject to restrictions on the business area to enable taking flexible responses to meet the demand for ship fuel in each area.
3. Main contents
A. Establishment of basis for the ex officio cancellation of port transportation business and harbor transport-related business (Establishment of Article 5 (3) and Article 26-3 (8) of the Draft)
If a port transportation businessman or a harbor transport-related businessman reports the closure of business to the head of the competent tax office, or the head of the competent tax office cancels the business registration, the competent authority may cancel the registration of the port transportation business and registration or report of the harbor transport-related business ex officio.
B. Expansion of harbor transport-related business not subject to restrictions on business areas (Establishment of Article 26-3 (6) of the Draft)
In principle, harbor transport-related businesses shall be registered or reported for each port, with the business area limited to the relevant port; however, a harbor transport-related business excluded from the restriction on business area is expanded by adding the case where fuel supply vehicles are registered as equipment for the bunker fuel supplying business.
C. Application of liability to measure the amount of fuel supplied by bunker fuel suppliers supplying foreign navigation vessels with fuel (Establishment of Article 26-3 (11) through Article 26-3 (15) of the Draft)
1) Liability for proper volume supply is established so that bunker fuel suppliers shall not supply foreign navigation vessels with fuel less than or exceeding the volume beyond the tolerance of the supply amount determined to be supplied.
2) Bunker fuel suppliers shall install bunker fuel supply-measuring devices that can measure whether the proper volume is supplied and shall keep the measurement results at the workplace.
3) In order to check the status of proper volume supply, the Minister of Oceans and Fisheries shall check whether bunker fuel suppliers installed devices for measuring the bunker fuel supply volumes, shall conduct sample inspections, and shall announce the results on the website.
