1. Reason for Enactment
The proposed legislation aims to prepare an Enforcement Decree following the enactment of the Act on Conservation and Utilization of Modern and Contemporary Cultural Heritages (Law No. 19702; enacted and promulgated on September 14, 2024; enforced on September 15, 2024), to facilitate the smooth implementation of modern and contemporary cultural heritage systems and the preservation and utilization framework.
2. Main Contents
A. Establishment of registration standards and procedures for state-registered cultural heritage assets (Articles 2 to 3 of the draft).
B. Establishment of procedures for designation and notification of essential preservation elements (Article 5 of the draft).
C. Establishment of the deadline and method of reporting state-registered cultural heritages (Article 7 of the draft).
D. Establishment of standards and procedures for permitting changes to the current status of state-registered cultural heritages (Article 9 of the draft).
E. Establishment of the period, procedure, and method of conducting regular audits and the procedure for requesting compensation for losses incurred during audits (Articles 12 to 15 of the draft).
F. Establishment of the reasons and procedures for cancellation of registration of state-registered cultural heritages (Article 16 of the draft).
G. Establishment of the details of special exceptions regarding the building-to-land ratio and the floor area ratio of state-registered cultural heritages (Article 18 of the draft).
H. Establishment of such matters as the designation standards for modern and contemporary cultural heritage districts (Article 20 of the draft).
I. Establishment of support projects, procedures and eligible recipients for modern and contemporary cultural heritage districts (Article 30 of the draft).
