1. Reason for Revision

The proposed revision aims to modify the relevant provisions so that the cost of basic education for radiation workers may be included in the contribution levied on the operators of nuclear facilities, by appointing the Nuclear Safety Commission as the entity responsible for providing the basic education to radiation workers, etc. rather than the operators of nuclear facilities, and to improve the regulatory system so that the users of nuclear fuel materials can be reasonably regulated in the same manner as the users of radioisotopes, etc. by imposing the obligation to appoint a safety manager and submit a safety report on the users of nuclear fuel materials in consideration of their similarity to the users of radioisotopes, etc. and by providing provisions that allow them to be exempted from periodic inspections when they are rated to maintain excellent safety management.


2. Main Contents

a. Improvement of the Regulatory System for Nuclear Fuel Materials Users (Article 45, Article 47, Article 48, and Article 51 of the draft)

- (Submission documents, Article 45) The revision requires safety reports to be submitted in addition to the safety management regulations.

- (Periodic Inspection, Article 47) The revision adds a new provision that exempts from periodic inspection in cases of excellent safety management.

- (Revocation of Permit, Article 48) The revision adds a new provision that allows the revocation of a permit in the event that a facility operator fails to start or discontinues its business.

- (Safety Manager, Article 51) The revision adds a new provision concerning the appointment of safety managers, etc.

b. New provision prohibiting the reporting of business closure during an administrative disposition period (Article 57-2 of the draft)

- The revision introduces a new provision prohibiting the reporting of business closure during an administrative disposition period in cases where a business is suspended or the use of a facility is prohibited referring to the Food Sanitation Act, Public Health Control Act, Distant Water Fisheries Development Act, etc.

c. Revision mandating the Nuclear Safety Commission as the entity responsible for workers’ basic education (Article 106 of the draft)

- The revision stipulates that the Nuclear Safety Commission shall henceforth be the entity responsible for providing basic education and workplace education, while the operators of nuclear businesses shall be responsible for providing other education and training. It also provides that the related education/training costs shall be defrayed from the contribution levied on the operators.
