1. Reason for Revision
The revision aims to strengthen penalties for fraudulent training by extending the sanction period from a maximum of 3 years to 5 years. This stricter sanction will help maintain order in the training market, ensure fair competition, and improve training quality. Additionally, to support youth employment, the revision includes recognizing work experience, training history, and business owner qualification acquired through government participation in overseas projects as job competencies. The recognition standards for job competencies and the format for job competency certificates are being revised to address some operational shortcomings in the current system.
2. Main Content
a. Strengthening Penalties for Fraudulent Training (Appendix 1, Appendix 1-2, Appendix 2)
- In cases where multiple reasons for restriction of delegation and recognition occur simultaneously, or when additional reasons arise during the restriction period, the sanction period for delegation and recognition restrictions is extended from a maximum of 3 years to 5 years.
b. Expansion of Job Competency Recognition Information (Appendix 3)
- Youth work experience overseas, training history, and business owner qualification information can now be managed through the Job Competency Bank. The job competency recognition standards are expanded to include business owner qualification information under qualifications, overseas training history under training, and overseas work experience under career information.
c. Revision of Personal Information Collection, Use, and Consent Form (Appendix Form 4)
- To provide clearer guidance on the collection and use of personal information when registering for the Job Competency Bank, the form will include a consent section for "encrypted user identification value (CI)" and add a new consent section for the collection and use of tax information.
d. Revision of Job Competency Certificate Format (Appendix Form 4-2)
- With the linkage of youth overseas work experience to the Job Competency Bank, a new item for work experience information will be added under career information. The format of the Job Competency Certificate will also be updated to allow the inclusion of certification numbers and business owner deregistration dates.
e. Regulation of Legal Forms (Article 16, Paragraph 1, Subparagraph 6, Article 4, Paragraph 4, Appendix Forms 4-4, 9, 9-2, 10, 11, 12, 13, 13-2, 13-3, 14, 15)
- Revisions will be made to eliminate unnecessary phrases and improve the design standards for forms, addressing user inconveniences and improving the clarity and utility of the forms.
