Background and Need for Government Intervention
The consumer-centered management certification is granted once a year (twice a year until 2024), and before issuing the certificate, the certification decision is made after review and resolution by the certification review committee.
The certification is valid for three years; however, if the company is subject to corrective actions due to violations of consumer-related laws, the certification may be revoked even within the validity period (Article 20-4 of the Basic Consumer Act).
In cases where a company applying for certification has an ongoing legal violation allegation resulting in sanctions beyond corrective actions, it is necessary to introduce a certification suspension system to resolve the uncertainty of determining the certification status before the legal violation is conclusively determined.
A similar system, the CP rating system, allows for suspension or non-award of the rating when a company is under investigation for violating fair trade-related laws and its case is under review by the Fair Trade Commission (Article 15 of the Regulation on the Operation and Evaluation of the Fair Trade Compliance Program (CP)).
If the company is deemed unsuitable for certification, it must reapply and obtain certification once the violation is resolved, leading to redundant time and cost expenditures.
Regulatory Content
If a company under investigation for sanctions beyond corrective actions applies for CCM certification, the decision on the certification will be suspended until the committee's resolution on the matter.
