Reasons for Proposal

The current Act stipulates that where a provider of information and communications services or a person who has received personal information of users from a provider of information and communications services (hereinafter “providers of information and communications services, etc.”) intends to collect, use, or provide personal information of users, he or she shall notify the users of the relevant facts and obtain consent therefrom.
However, critics point out that many users do not often read consent forms as they find them a nuisance or difficult to understand, making it difficult for users to determine the extent to which their personal information is utilized.
Accordingly, the Amendment introduces a rating system for personal information usage and requires providers of information and communications services, etc., to notify the users of their own rating when obtaining consent from them, thereby enabling users to clearly and easily recognize how their personal information will be utilized and pay more attention to personal information protection (Article 26-3 newly inserted).

Major Provisions

Prescribe that a person who intends to obtain consent for the collection, use, provision, etc. of personal information shall notify users of his or her personal information usage rating (Article 26-3, paragraph 2)
