Reasons for Proposal

Recently, there are growing concerns over child safety due to increasing numbers of accidents concerning a child left alone on a school bus in the extreme heat. The current Act obligates drivers of school buses for children to check whether all children have alighted therefrom after the completion of his/her driving service each time, but similar accidents recur every year due to lenient punishment.
Therefore, various measures are being discussed to prevent the recurrence of similar accidents by supplementing institutional devices. Some countires like America has obligated the installation of a device to check whether children have alighted from school buses for children, and some local governments of Korea has separately implemented such system, there is an increasing demand for effective measures against children’s safety accidents.
Accordingly, this Amendment aims to obligate operators of school buses for children to install and operate at least one (1) device to check whether children have alighted therefrom, and to allow them to receive support for the installment from state or local governments, thereby enhancing the safety for children and infants, and providing practical support to operators of school buses for children (Articles 52, 53, 53-5 and 160).

Major Provisions

Motor vehicles that can be used as school buses for children shall be limited to motor vehicles prescribed by Ordinance of the Ministry of the Interior and Safety. In such cases, such motor vehicles shall meet requirements prescribed by Presidential Decree, such as paintwork, markings, current insurance policy, and the relationship to owner, etc., (Article 51, paragraph 3).
