Reasons for Proposal

The current Act provides a basis for administrative dispositions such as correction orders, suspension of business, cancellation of registration of business, etc., based on the seriousness of intentional or neglectful poor construction. However, due to the lack of standards for cancellation of registration of business, only correction orders and suspensions of business are being issued.

Poor construction of a serious kind not only takes a huge toll on the safety for construction workers and residents (users) after completion, but also creates social issues such as the shortening of the lifespan of the structures. It is an illegal act that damages the decorum of the entire construction industry.

Therefore, this Amendment seeks to prevent the recurrence of poor construction by adding to the list of Cancellation, etc., of Registration of Construction Business the following: where a person poorly performs construction work intentionally or by negligence to cause serious damage to the major structural part of a facility and thereby to place the public in danger, casting such person out of the construction industry for at least five years. (Article 83).
