Reasons for Proposal
Motor vehicle tuning has the potential to create a new growth engine through convergence with the same industry and different industries based on the technical know-how and forward and backward linkage of industries; and motor vehicle tuning business is not only a manufacturing industry but also a labor-intensive industry with a large job creation effect.
The government has been continuously establishing and implementing policies related to the motor vehicle tuning industry; however, because tuning of vehicles is clearly different from service-oriented motor vehicle maintenance in terms of business category and differs in size from ordinary small and medium-sized companies, there is a limit to managing, supporting, and promoting the motor vehicle tuning industry through existing laws for motor vehicle maintenance.
Therefore, this Act aims to prepare a political support system appropriate to the motor vehicle tuning industry, revitalize the motor vehicle manufacturing industry, and develop the motor vehicle tuning industry into a high-value-creating industry, based on the innovation of automobile technology and manufacturing/processing technology, by strengthening the competitiveness of the tuning industry and actively responding to changes in motor vehicle technology and preparing the grounds for the industry to become a new growth engine, and enacting the Motor Vehicle Tuning Industry Act.
Details
A. The term "motor vehicle tuning industry" means a business category that engages in business using the technology of motor vehicle tuning or manufacturing parts which are used for motor vehicle tuning, which is prescribed by Presidential Decree (Article 2).
B. The Minister of Trade, Industry and Energy shall establish and implement a basic plan to promote the motor vehicle tuning industry every five years through consultation with the heads of related central administrative agencies and deliberation of the Motor Vehicle Tuning Industry Development Committee (Article 5).
C. Establish a Motor Vehicle Tuning Industry Development Committee in the Ministry of Trade, Industry and Energy to deliberate on the establishment and implementation of a basic plan for the development of the motor vehicle tuning industry (Article 7)
D. Those who intend to perform the motor vehicle tuning business shall register with the head of the competent Si/Gun/Gu, as prescribed by Ordinance of the Ministry of Trade, Industry and Energy (Article 12).
E. Establish a provision that when motor vehicle tuning business entities tune motor vehicles, the motor vehicle tuning shall be under the safety standard of motor vehicles and the safety standard of parts stipulated in Article 29 of the Motor Vehicle Management Act and they shall be subject to punishment with penalties for any violation (Article 14).
F. Any person who is engaged in the motor vehicle tuning industry and wants to be recognized as a motor vehicle tuning technician/skilled person shall report to the Minister of Trade, Industry and Energy the matters necessary for the management of his/her workplace, career, educational background, and qualifications, as prescribed by Ordinance of the Ministry of Trade, Industry and Energy (Article 16).
G. The State or a local autonomous government may provide necessary support such as administrative and financial support to enhance the competitiveness of the motor vehicle tuning industry (Article 20).
H. Motor vehicle tuning business entities may establish a motor vehicle tuning industry association under the approval of the Minister of Trade, Industry and Energy to promote the development of the motor vehicle tuning industry and improvement of motor vehicle tuning technology (Article 21).
(I) Anyone who is engaged in a motor vehicle tuning business without registering with the Minister of Trade, Industry and Energy shall be punished by imprisonment for not more than three years or a fine not exceeding 30 million won (Article 27).

This legislative bill is subject to the resolution of the “partial revision to the Motor Vehicle Management Act (Bill No.18975)," which was proposed by Yoon Youngil, Member of Parliament, and thus, if the legislative bill is not passed or is amended, it should be adjusted accordingly.
