Reasons for Proposal

The current law stipulates that a business owner of a workplace with a certain size or above shall establish a workplace child care center either alone or jointly with a local child care center and that if a business owner fails to perform this duty, a charge for compelling compliance may be imposed and collected not exceeding 100 million won each time, up to twice a year.
However, since the Enforcement Decree stipulates that the criteria for a workplace which is obliged to establish a workplace child care center is a workplace which hires at least 300 full-time female workers or at least 500 full-time workers, it is necessary to strengthen the criteria along with improving the binary criteria by gender, and because there are some business owners who pay the charge for compelling compliance without performing their duties such as the establishment of a workplace child care center, it is necessary to strengthen the effectiveness of the charge for compelling compliance.
Therefore, the amendment aims to stipulate the provision that a business owner of a workplace which hires at least 300 full-time workers are obliged to establish a workplace child care center, and to impose and collect an additional 50% of the amount imposed immediately before if the charge for compelling compliance is imposed more than twice, raising the range of the charge for compelling compliance (Article 14 (1) and Article 44-3 (1)).


Major Provisions

Article 14 (Establishment, etc., of Workplace Child Care Centers) (1) Each business owner, who operates a workplace with at least 300 full-time workers, shall establish workplace child care centers: Provided, that where a business owner is unable to establish a workplace child care center alone, he/she shall establish and operate a joint workplace child care center with other business owners, or conclude an entrustment contract for child care services with a local child care center (hereinafter referred to as "entrusted child care services" in this Article) to support his/her employees.
