Reasons for Proposal

To protect consumers, the current Act prohibits unfair labelling or advertising and imposes an obligation to verify matters concerning facts included in labels or advertising.
However, since if a business entity does not submit verification data, the Fair Trade Commission has to take considerable time and economic costs to judge the unfairness of a relevant label and advertisement, there are criticisms that it is inefficient.
Therefore, this amendment aims to strengthen the effectiveness of the obligation to submit verification data imposed to business entities and to protect consumers’ rights by expanding the measures, which the Fair Trade Commission is able to take if a business entity submits no verification data, from the suspension of labelling or advertising to the announcement of the fact that the business entity has submitted no verification data or any other measures as prescribed by Presidential Decree (Article 5 (5)).

Major Provisions

Suspension of placing labeling or advertising (Article 5 (5) 1), announcement of the fact that no verification data has been submitted (Article 5 (5) 2), or any other measures as prescribed by Presidential Decree to secure verification data (Article 5 (5) 3)
