Reasons for Proposal
The current Rules on Occupational Safety and Health Standards require employers to provide a break facility available for use during rest breaks to enable employees to relieve their physical fatigue and emotional stress.
However, the current Act does not prescribe an obligation for business owners to install break facilities nor are there sanctions for non-compliance. As a result, despite the Rules, places of business are often not equipped with break facilities and in those businesses that do provide break facilities, they are often of poor quality.
Accordingly, the Amendment prescribes an obligation to install break facilities and grounds on which to delegate installation and management standards, and allows the Minister of Employment and Labor to check and determine the operational status of break facilities, thereby aiming to ensure the availability of suitable break facilities in places of business (Article 128-2, Article 128-3, and Article 175).
