Reasons for Proposal

In case of a traffic accident due to motor vehicle operation, information regarding the status of major motor vehicle devices related to the accident such as engines, airbags, transmissions, etc., at the time of the accident is necessary to understand the circumstances and to resolve disputes.

Especially for major devices closely related to accident damage such as airbags, etc., which contain records of the accident in their control systems, it is currently the case that motor vehicle users and insurance companies cannot utilize such records because only the motor vehicle manufacturer has the special skills necessary to decipher the records.

Therefore, this Act aims to enable a motor vehicle user in an accident incurred during motor vehicle operation and/or stoppage, to make a request to a motor vehicle manufacturer, etc., to provide data regarding major motor vehicle devices related to the accident and to decipher records contained in such control devices, etc., while also obliging motor vehicle manufacturers, etc., to comply with such requests, thereby protecting the right to know of motor vehicle accident victims and facilitating resolution of disputes (Article 33-4 and Article 79, subparagraph 1-2, newly inserted).
