Reasons for Proposal
Despite numerous criticisms of problems with plans for preventing harm and danger submitted by construction companies, for example a major fire at a warehouse in Icheon in April 2020 that left 38 people dead and 10 people injured, construction has proceeded without improvements.
In particular, a vicious cycle is repeated where fires are presumably caused by oil mist produced by urethane work and a yet unidentified fire source (welding work) leading to explosion and the spread of flames and causing numerous casualties, etc.
Therefore, this proposal aims to prescribe in the Act matters regarding construction involving inflammable materials including the installation, etc. of ventilation facilities such as hoods, ducts, ventilators and exhaust pipes, which are currently prescribed in the Rule on Occupational Safety and Health Act, thereby seeking to protect workers’ safety from major fires and prevent fire accidents in advance (Article 38 (4), Article 167 (1), subparagraph 1 of Article 168, subparagraph 1 of Article 174).
Major Provisions
Impose a duty on a business owner to take necessary measures such as the installation of ventilation devices and ventilators, etc. to ensure workers’ safety and prevent fire accidents (Article 38 (4)).
