Reasons for Proposal
The current Act allows the Special Metropolitan City Mayor, Metropolitan City Mayor, Special Self-Governing City Mayor, Special Self-Governing Province Governor, or head of Si/Gun/Gu to inspect whether noise from motor vehicles complies with permissible running car noise standards prescribed by Presidential Decree, a muffler or silencer has been removed, and an additional horn has been attached, and to impose a 2 million won on any motor vehicle owner who violates the foregoing.
However, as effective inspection is not performed by local governments, which have the authority to crack down on permissible running car noise standards, complaints due to vehicle noise during day and night continue to be filed.
In this regard, this Act aims to mandate local government's inspection on whether permissible running car noise standards are met, require local governments to report their inspection outcomes to the Minister of Environment, and increase administrative fines on any person who violates permissible running car noise standards (Articles 36 and 60 (2) newly inserted).
