Reasons for Proposal

The current Act requires persons intending to operate any zoo or aquarium to register their zoo or aquarium with the Mayor/Do Governor without preparing the legal basis for the habitat of animals, and allows such persons to follow a habitat plan established by themselves.

Some zoos take advantage of such a lack of relevant regulations and raise animals in harsh conditions that do not consider the animals’ natural ecological home and  which even threatens their life in some cases. Nonetheless, there is a lack of legal basis to impose appropriate penalties for such acts.

Hence, this Act aims to prepare the basis for allowing a Presidential Decree to prescribe the habitat standards with which persons intending to operate any zoo or aquarium must comply, impose up to 5 million won in administrative fines on anyone who violates these standards and lets animals die, and promote the welfare of wild animals in zoos and aquariums (Articles 3 (1), 6, and 18).
