Reasons for Proposal

Recently, it has been pointed out that the Agency for Defense Development (ADD) is the source of leaks of national secrets due to a lax security system and suspicions about leaking of defense technologies by retired ADD researchers.

Thorough management and supervision of defense industry technology-related research institutes and defense contractors that have a significant impact on national security must be conducted; however, due to the inadequacies of the existing system, defense technology is exposed to the risk of leaks and infringement.

Accordingly, the Act aims to promptly respond to acts of leaking and infringing defense technology by illegal means by specifying that the Minister of the Defense Acquisition Program Administration or the head of the intelligence and investigative agency investigate leaks and infringement of defense technology.

In addition, the Act specifically prescribes the methods, procedures, and limits of investigation since the 「Framework Act on Administrative Investigations」 does not apply to investigations into matters related to defense acquisition programs (Article 11 and Article 11-2).


Major Provisions

Article 11-2 (Investigation) ① The Minister of the Defense Acquisition Program Administration or the head of the intelligence and investigative agency may ask the person subject to investigation (corporation, organization, agency or individual subject to investigation) to appear, make statements, report, and read documents in order to collect information and materials necessary for identifying leaks and infringement of defense technology.
