Reasons for Proposal
The current Act requires the owners of port facilities to have the facilities and equipment required for security screening of passengers on passenger ships on international voyages and port facilities.
The Aviation Security Act ensures the efficient management of the use of aviation security equipment by airport operators and air transportation business entities, etc. by newly inserting provisions concerning the performance of aviation security equipment; standards, methods, and procedures for certification; performance testing of security equipment; and other matters necessary for operation. However, the current Act does not contain provisions concerning the standards, methods, and procedures for domestic certification of security equipment; performance testing of security equipment; or other matters necessary for operation with respect to the installation of security equipment in port facilities.
Port security is an important matter concerning passenger safety and national security. Thus, it is necessary to ensure that security equipment in port facilities demonstrates a sufficient level of anti-terrorism screening ability, etc., by prescribing that only equipment that has been certified by a professional institution may be used. Considering that the Railroad Safety Act is already implemented for the installation of security equipment in railroad facilities, which are similar to port facilities, it is needed to take action to take immediate legislative action.
In this regard, this Act aims to introduce a performance certification system that requires the use of only security equipment certified by the government in port facilities under the current Act, just as the equipment operator under the Aviation Security Act uses the certified security equipment to perform a security check (Articles 30-2, 30-3 through 30-8, 46, and 52).
