Reasons for Proposal

The sharing economy, which includes economic activities that generate social, economic, and environmental value by sharing resources such as space, goods, information, talent, and experience, is growing rapidly and expanding its influence from traditional businesses such as taxi hailing and accommodations to the latest ones such as digital content transactions.

While many local governments have prepared and implemented ordinances to support and manage the sharing economy, there is no legal support and management framework at the national level for the sharing economy, and it is becoming a social consensus to systematically manage the sharing economy.

In this regard, this Act aims to maximize the use of resources and boost the local economy by preparing a national-level legal support and management framework for the sharing economy, lay the foundation for new economic growth in the 4th Industrial Revolution, and contribute to the balanced development of the people’s economy.

Details

A. Aim to contribute to the balanced development of the people’s economy by defining basic matters required to maximize the use of resources and boost the local economy in promoting the sharing economy (Article 1)

B. Define the “sharing economy” as an economic activity that generates social, economic, and environmental value by sharing resources such as space, goods, information, talent, and experience (Article 2)

C. Require the central government to establish and implement comprehensive support policies to promote the sharing economy and local governments to establish and implement policies to promote the local sharing economy, considering the characteristics of their jurisdiction under the central government's policies (Article 3)

D. Require the Minister of Strategy and Finance to establish a master plan to promote the sharing economy every 5 years and establish and implement annual action plans under the master plan, and allow City/Do Mayors to establish and implement annual action plans under the master plan (Article 5)

E. Place the Sharing Economy Policy Review Committee under the Minister of Strategy and Finance to review important matters regarding the sharing economy (Article 6)

F. Require the Minister of Strategy and Finance to designate any person that brokers a transaction between customer and supplier in the sharing economy as an intermediary upon review by the Committee (Article 8)

G. Allow the Minister of Strategy and Finance to provide administrative and financial support to intermediaries who promote the sharing economy upon review by the Committee (Article 9)

H. Require intermediaries to fulfill obligations such as narrowing the information gap between customers and suppliers, protecting and managing personal information, and preparing complaint handling and damage rectification procedures (Article 10)

I. Require the Minister of Strategy and Finance to divide suppliers into temporary and permanent based on their transaction amount and frequency in each type of business (Article 11)

J. Require the Minister of Strategy and Finance to prepare improvements in the system in consultation with relevant central administrative agencies and local governments related to sharing economy policies so that sharing economy regulations can be eased for temporary suppliers (Article 12)
