Reasons for Proposal
While the central and local governments need to seek policies consistently and respond jointly to spread new and renewable energy, local governments currently do not establish dissemination plans in connection with the central government’s dissemination plan, which shows there is a lack of policy connection between the central and local governments. In this regard, this Act aims to prepare the basis by which the central government can support a dissemination plan established by a local government to effectively pursue the dissemination and expansion of new and renewable energy.
Furthermore, distance regulations on renewable energy generation equipment, which have been recently created by local governments, pose an obstacle to obtaining enough land for renewable energy. Hence, to encourage local governments to abolish distance regulations on new and renewable energy generation equipment, this Act aims to prepare the basis to provide support if local governments remove such regulations.
While it is expected to be necessary to secure a large area of land to reach the country’s renewable energy dissemination goals and find eco-friendly sources of power generation during this ongoing climate change, there is a lack of regulations on renewable energy development, which makes it difficult to proceed with development. In this regard, this Act aims to define the designation, development, and operation of renewable energy development districts and prepare the legal basis for seeking a large-scale renewable energy development project swiftly and efficiently.
Details
A. Allow the Minister of Trade, Industry and Energy to support the establishment and implementation of new and renewable energy technological development, use, and distribution plans by local governments (Article 7-2 newly inserted)
B. Allow the New and Renewable Energy Policy Council to deal with matters related to renewable energy development districts (Article 8 (2) 3-2 newly inserted)
C. Allow the Minister of Trade, Industry and Energy to prioritize his/her support for the local governments which have not set any separation distance for renewable energy generation equipment (Article 26-2 newly inserted).
D. Define designation procedures for renewable energy development districts to prevent unplanned and indiscriminate development, ensure acceptance, and effectively pursue renewable energy generation projects (Article 28-2 newly inserted)
E. Require the Minister of Trade, Industry and Energy’s approval on an action plan to proceed with any renewable energy development district project (Article 28-6 newly inserted)
F. Provide the effect of certification and/or permit under other applicable laws if the Minister of Trade, Industry and Energy approves an action plan under Article 28-6 (Article 28-7 newly inserted)
G. Allow liquidating renewable energy development districts with the Minister of Trade, Industry and Energy’s approval to encourage active development in renewable energy development districts (Article 28-10 newly inserted)
H. Allow the Minister of Trade, Industry and Energy to designate an organization responsible for renewable energy development districts if required to efficiently pursue activities related to the designation and development of renewable energy development districts (Article 28-13 newly inserted)
