Reasons for Proposal
Autonomous vehicles (AVs), which self-determine and navigate based on information gathered by onboard recognition devices, are acting as the central axis of future mobility innovation. Countries worldwide are accelerating the development of driving technology and service demonstration with the goal of achieving full autonomous driving commercialization and securing a technological lead by the 2030s.
Therefore, in preparation for the commercialization of these autonomous vehicles, it is necessary to preemptively establish the legal and institutional foundation across the entire road traffic system, including road traffic operation and the licensing system.
To prepare for the autonomous driving era, this proposal aims to lay the groundwork for the commercialization of autonomous driving technology by enacting a Special Act on Road Traffic of Autonomous Vehicles. This involves:
1. Replacing the concept of the driver with the concept of the operator to reflect the characteristics of autonomous vehicles, which do not always have an occupying driver, and aligning the term with the vehicle's purpose.
2. Introducing an autonomous driving license as a simplified licensing system.
3. Establishing a legal basis for the Commissioner General of the Korean National Police Agency to provide autonomous driving traffic information.

Imposition of the Obligation on the Autonomous Vehicle Operator to Directly Operate the Driving Controls when the Autonomous Driving System Requires Direct Driving Intervention (e.g., Draft Article 6, Paragraph 1).
